ZAM ZAM FARMS MEMBERSHIP
Please use the following form to apply for membership. After you submit this form, check your email for updates from us within 24 to 48 hours. You will receive an email that you have been approved for membership. At that time your membership has been activated and you are now authorized to partake in all of the benefits of becoming a member. Please fill out all the requested information, this will make it easier for our staff to verify you in the event you misplace your membership confirmation. MEMBERSHIP & LIABILITY WAIVER
Private Membership Association Agreement
1. Assumption of Risk I, the undersigned, understand that I am entering a private membership association (Private Membership Association) with Zam Zam Farm. I understand that [Zam Zam Farms] produces, prepares, and provides food, raw dairy, agricultural products, and farm services (collectively, "Products & Services") that are not inspected, certified, or regulated by the FDA, USDA, or any state-level agency. I acknowledge that the consumption of raw, farm-fresh, or unpasteurized products may involve inherent risks of illness or injury, including but not limited to foodborne illness, allergic reactions, or bacterial contamination. I voluntarily, knowingly, and freely assume all risks, both known and unknown, even if arising from the negligence of the Farm or others, and I assume full responsibility for my participation and the consumption of any products.
2. Release and Waiver of Liability I, for myself, my heirs, personal representatives, and assigns, hereby release, waive, discharge, and covenant not to sue Zam Zam Farms, its owners, agents, employees, and volunteers (collectively, "Releasees") from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, injury, or death that may be sustained by me, or to any property belonging to me, while participating in any activity, receiving services, or consuming products from the Farm.
3. Specific Liability Release (Food & Products) I expressly agree that the Releasees are not responsible for any illness, adverse reaction, or injury resulting from the consumption, use, or handling of any food, dairy, or agricultural product provided by Zam Zam Farms. I waive any right to claim that products provided were defective, unsafe, or contaminated.
4. Indemnification I agree to indemnify and hold harmless the Releasees from any loss, liability, damage, or costs, including court costs and attorney’s fees, that they may incur due to my participation in the Farm’s activities or consumption of its products
5. Affirmation of Membership I affirm that I have joined this Private Membership Association to seek out, purchase, and consume the products of my choice and to support local, independent, and chemical-free food production.
I HAVE READ THIS WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
